Kesh Business Hub designs and builds custom AI solutions, including AI chatbots and messaging agents, voice and call agents, business automation, document and data tools, SaaS application development, and AI consulting. The specific scope, deliverables, and timeline for any engagement are defined in a separate proposal, statement of work, or written agreement.
Any consultation, quote, or proposal we provide is for discussion purposes and does not create a binding contract until confirmed in writing by both parties. Where a proposal or statement of work conflicts with these Terms, the signed proposal or statement of work prevails for that engagement.
To deliver our services, we rely on your timely cooperation. You agree to provide accurate information, necessary access and materials, and prompt feedback and approvals. You are responsible for ensuring that any content, data, or credentials you provide do not infringe the rights of others and comply with applicable law.
The Site and its content, including our name, logo, text, and design, are owned by or licensed to Kesh Business Hub and are protected by intellectual-property laws. Ownership of custom work produced for a client is determined by the applicable engagement agreement; absent such terms, we retain ownership of our pre-existing materials, tools, and know-how, and grant you a licence to use the delivered solution for its intended purpose.
Our solutions may use artificial-intelligence and machine-learning technologies, including third-party AI models. You acknowledge that AI systems are probabilistic and may produce output that is inaccurate, incomplete, or unexpected. AI outputs are provided as tools to assist, not to replace, human judgement, and should be reviewed before being relied upon for important decisions. We do not warrant that any AI feature will be error-free or fit for a particular purpose beyond what is expressly agreed in an engagement.
Our solutions may integrate with third-party platforms and services (for example messaging, hosting, payment, and AI providers). Your use of those services is subject to their own terms, and we are not responsible for their availability, performance, or actions.
Each party may receive confidential information from the other in the course of an engagement. Both parties agree to protect such information and to use it only for the purposes of the engagement, except where disclosure is required by law. Specific confidentiality obligations may be set out in a separate agreement.
The Site and, except as expressly agreed in an engagement, our services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free.
To the maximum extent permitted by law, Kesh Business Hub will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Site or our services. Our total aggregate liability arising out of or related to an engagement will not exceed the amounts you paid to us for that engagement in the twelve months preceding the claim.
You agree to indemnify and hold harmless Kesh Business Hub and its members and personnel from any claims, damages, liabilities, and expenses arising out of your misuse of the Site or services, your violation of these Terms, or your infringement of the rights of any third party.
We may suspend or terminate your access to the Site at any time if you violate these Terms. Termination of a services engagement is governed by the applicable engagement agreement. Provisions that by their nature should survive termination — including intellectual property, confidentiality, disclaimers, limitation of liability, and indemnification — will survive.
These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or our services will be subject to the exclusive jurisdiction of the state and federal courts located in the State of Wyoming, unless otherwise required by applicable law.
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the Site or our services after changes take effect constitutes acceptance of the updated Terms.
